Terms and Conditions (“Terms”)

This College Forward User License Agreement (“Agreement”) is a contract between you the individual accessing this College Forward app (“You” or “Your”) and College Forward, a Texas non-profit corporation (“College Forward”). As used in this Agreement, the “App” means the College Forward app that You are downloading or that has been downloaded to the mobile device You are using, and it includes all corrections, bug fixes, enhancements, updates, or other modifications thereto that are supplied or otherwise made available by College Forward. 

It is important that You read carefully and understand the terms and conditions of this Agreement. By using the App, You agree to be bound by this Agreement. If You do not agree to these terms and conditions, do not use the App and please delete it from the applicable mobile device. 

TAKING ANY STEP TO ACCESS OR USE THE APP OR ANY SERVICES PROVIDED IN CONNECTION WITH THE APP CONSTITUTES YOUR ASSENT TO AND ACCEPTANCE OF THIS AGREEMENT. 

YOU REPRESENT THAT YOU ARE AT LEAST 16 YEARS OF AGE. 

You also understand that in using the App, it may be necessary for You to provide certain information for use by College Forward and/or the App. You agree to always provide true, correct, and complete information to the best of Your knowledge and to update such information on a timely basis so that it remains accurate. You agree that College Forward may at all times both during and after the term of this Agreement use and disclose all of such information in accordance with the College Forward Student Application that You have submitted. If You have not submitted a College Forward Student Application, You acknowledge that College Forward may use any and all of the information You provide in accordance with its then published terms and conditions set forth at http://collegeforward.org/privacy-terms/. 

College Forward grants You a limited, non-exclusive, non-transferable right to use the App solely for Your own personal, non-commercial use with respect to Your seeking admission to, and as applicable, attendance of, college.

In connection with Your use of the App, You authorize College Forward to release Your information to the educational institutions selected in Your College Forward Student Application or that You have designated to College Forward via the App and that College Forward may further use anonymized or statistical compilations of Your information for research and educational reporting. You understand that such information may include, among other things, Your contact information, attendance at required meetings, completion of community service, state and federal financial aid eligibility, FAFSA data, postsecondary enrollment status, academic status, and residency and location information. 

As between You and College Forward, College Forward retains all right, title, and interest in and to the copyright and any other intellectual property rights in the App, subject only to the foregoing limited license granted to You. You do not acquire any other rights, express or implied, in the App other than those rights expressly granted under this Agreement. The trademarks, logos, and service marks displayed on the App are the registered or unregistered trademarks or service marks of College Forward and/or its licensors. You are not authorized to use these marks in any manner. 

If the App is password protected, YOU ARE ENTIRELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR USERNAME AND PASSWORD AND FOR ANY AND ALL ACTIVITIES THAT ARE CONDUCTED THROUGH YOUR ACCOUNT. If You have reason to believe that Your account with College Forward is no longer secure, You must promptly change Your password and You should promptly notify College Forward. 

You agree to the following: 

1. You will not knowingly engage in any fraud, misrepresentation, or unethical behavior in using the App; 
2. You will not use the App or any corresponding services for unlawful purposes; 

iii. If you are under the age of 18, you have received permission from each of your parents or guardians to use the App and to provide any information or materials you upload using the App; 

1. You are solely responsible for how You use the App and any corresponding services, including all results You might obtain; 
2. College Forward is not able to make any representations or guarantees as the results You might achieve from using the App or any corresponding services; and 
3. College Forward is free, but not obligated, to use as it deems appropriate without any obligation to You any suggestions or modifications You might suggest to the App.

THE APP AND ANY SERVICES YOU MIGHT RECEIVE IN CONNECTION WITH THE APP ARE PROVIDED ON AN “AS IS”, “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES AS TO TITLE, INFRINGEMENT OF THIRD-PARTY RIGHTS, OR ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. COLLEGE FORWARD DOES NOT AND CANNOT WARRANT THE PERFORMANCE OR RESULTS YOU MAY OBTAIN BY USING THE APP OR ANY SERVICE YOU MIGHT RECEIVE IN CONNECTION WITH THE APP. COLLEGE FORWARD DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR FREE, OR SECURE. FURTHER, COLLEGE FORWARD THAT IT CAN OR WILL ALWAYS PROPERLY AND TIMELY SUBMIT TO APPLICABLE COLLEGES AND UNIVERSITIES RELEVANT MATERIALS YOU HAVE COMPLETED OR THAT YOU WILL BE ACCEPTED BY OR, IF APPLICABLE, ABLE TO REMAIN ENROLLED IN, A PARTICULAR COLLEGE OR UNIVERSITY. 

This Agreement is deemed to have been entered into in the State of Texas and its interpretation, construction, and the remedies for enforcement or breach are to be applied pursuant to, and in accordance with, the laws of the State of Texas without regard to any law or regulation that might seek to impose the laws of another state or jurisdiction. 

Where the context so indicates, a word in the singular form shall include the plural, a word in the masculine form the feminine, and vice-versa. The term “include” and similar terms (e.g., includes, including, included, comprises, comprising, such as, e.g., for example), when used as part of a phrase including one or more specific items, are used by way of example and not of limitation. College Forward shall not be liable for delays in performance or for non-performance due to failure or interruption of computer or telecommunication systems, acts of God, war, riot, fire, terrorism, third party labor trouble, unavailability of materials or components, explosion, accident, compliance with governmental requests, laws, regulations, orders or actions, or other unforeseen circumstances or causes beyond College Forward’s reasonable control. This Agreement constitutes the entire agreement between You and College Forward regarding Your use of the App, and supersedes all previous communications, representations, understandings, and agreements, either oral or written. The rights, remedies and protections afforded to College Forward under this Agreement, including but not limited to, limitation of remedy and liability and limited warranty shall extend to College Forward and to its affiliates and vendors performing or supplying work, services, or other deliverables under this Agreement. All provisions of this Agreement shall survive the termination or expiration of this Agreement to the fullest extent necessary to give the parties the full benefit of the bargain expressed herein and of the intent contemplated hereunder.
